Introduction

Rowville Library Chinese Friendships Group in Victoria of Australia was established in March 2007 under the initiatives of the committed librarians and communities.  The group is currently consist of approximately 15 members of Chinese seniors mainly around the Rowville area.  Space of activity is sponsored by the library authorities.

Pengenalan

Kumpulan Persahabatan Perpustakaan Rowville di Victoria bagi Australia ditubuhkan pada bulan Mac 2007 atas inisiatif-inisiatif bagi pustakawan-pustakawan dan komuniti-komuniti terbabit.  Kumpulan tersebut kini mengandungi lebih kurang 15 orang ahli yang kebanyakannya orang tua yang tinggal di sekitar kawasan Rowville.  Ruang bagi aktiviti adalah ditaja pihak-pihak berkuasa perpustakaan.

 

Objectives

The friendship group will be able to provide convenient space in public venues for Chinese communities in Rowville area to discuss various issues.  The activity will encourage the full utilization of facilities and books typically allocated for Chinese communities of the library.

这友谊组将会为在罗维尔区华人社区提供方便的公共空间以讨论各种事项。这活动将会鼓励更完善的设施与书本应用,特别是拨给图书馆的华裔社区。

 

Objektif

Kumpulan persahabatan akan memperuntukan ruangan yang selesa di kawasan awam untuk komuniti Cina di Rowville untuk membincang pelbagai isu.  Aktiviti tersebut akan menggalakkan penggunaan prasarana dan buku dengan sepenuhnya yang diberikan kepada komuniti-komuniti Cina di perpustakaan tersebut.

 

Activities

The usual meeting is held on every Thursday, from 10:30 AM to 12 PM in Rowville Library (Stud Park Shopping Centre, Stud Road, Rowville, Victoria VIC 3178, Australia; Melway 81J1) meeting room.  Gatherings in Chinese Lunar New Year, Christmas and other Chinese events with program servings are available specially.  Tea, biscuits, newspapers and books are prepared in every meeting day.  Special outings are organized by some initiated active members.  Special meeting is held on every Monday, from 1 to 3 PM in Knox Library (Knox City Shopping Centre, 425, Burwood Highway, Wantirna South, Victoria VIC 3152, Australia; Melway 63K11) meeting room.

Aktiviti

Mesyuarat biasa berada pada setiap hari Khamis dari pukul 10:30 pagi sehingga 12 tengahari di bilik mesyuarat Perpustakaan Rowville (Pusat Beli-belah Taman Stud, Jalan Stud, Rowville, Victoria VIC 3178, Australia; Melway 81J1).  Perhimpunan-perhimpunan Tahun Baru Cina, Krismas dan program-program Cina lain yang khas juga disediakan.  Teh, biskut-biskut, suratkhabar dan buku-buku disediakan pada setiap hari mesyuarat.  Aktiviti luar yang khas diorganisasikan atas inisiatif sesetengah ahli yang aktif.  Mesyuarat khas berada pada setiap hari Isnin dari pukul 1 sehingga 3 tengahari di bilik mesyuarat Perpustakaan Knox (Pusat Beli-belah Knox, Lebuhraya Burwood, Selatan Wantirna, Victoria VIC 3152, Australia; Melway 63K11).

CONSTITUTION FOR ROWVILLE LIBRARY CHINESE FRIENDSHIP GROUP AS A CHARITABLE ORGANIZATION WITH AUSTRALIAN BUSINESS NUMBER (ABN) : 25653005327

 

 

Section 1 : OBJECTIVES

The enhancement of the life-long education for the well-beings of the Chinese people and multicultural communities as a whole.

 

Section 2 : BRIEF INTRODUCTION

The Group was established in March 2007.  The first location started this activity is in Rowville Library situated in Rowville region for the state of Victoria in Australia, consisting initially of 15 founding members.

 

Section 3 : MEMBERSHIP CONDITIONS

The Group (means Rowville Library Chinese Friendship Group) welcomes every local resident to become a member.

 

Section 4 : MEMBERSHIP FEES

The memberships for the group is free for everybody with zero fees.

 

Section 5 : DONATIONS

All sorts of money donation could be directed to the Treasurer of the Group.  The Group also welcomes the supply of books, equipment, transport, food and other necessities for the establishment and sustainability of the organization.

 

Section 6 : BANK ACCOUNT INFORMATION

All money will be placed in the selected bank with account number maintained by the treasurer, for various activity uses.  It is the responsibility of the treasurer of the society to maintain proper bank account and the cash-flow information of the Group.

 

Section 7 : COMMITTEE MEMBERS

Approximately 15 members are required for the Establishment Committee based on the regulations provided.  3 of the starting members are classified into Executive Committee (EXCO) and the other 12 are grouped into Subordinate Committee (SUBCOM) of which the tentative responsibilities are outlined below :

 

7.1  Executive Committee (EXCO) : Consisting of the president, vice president, secretary, vice secretary and treasurer.

7.1.1 President

President is the chief of the Group, EXCO and representative to external organizations.  The president will be assisted by the vice president in the management of the organization.  The president is also the head of the disciplinary unit consisting of president, vice president, secretary, treasurer and one observer.  The disciplinary unit serves to make investigation, evaluation and judgement related to the matters that are against the principal and regulations of the Group.  The disciplinary unit reserves the rights to suspend the memberships of those are seriously against the Regulations / Constitution set within the Group.  All appeals could be made within 14 days to one month after receiving the formal letter from the disciplinary unit.

 

 

7.1.2 Secretary

 

The secretary is the head of publication in all the correspondence in and out of the Group.  The secretary is assisted by 1 vice secretary in the preparation of document for the Group uses, correspondence and electronic communication.  It is also the responsibility of the secretary to maintain a proper website, managing the group messages of the Group and the maintenance of e-mail relevant to the issues and welfare of the organization.  The secretary will be assisted by SUBCOM and members in updating the information of the Group on web, management of the book resources in the Group and planning the activity of the Group.

 

7.1.3 Treasurer

 

The responsibility of the treasurer is to ensure proper financial situation and the management of the money donation of the Group, inclusive of the collection and spending of membership fees and the support from the public as in Section 4 : MEMBERSHIP FEES, Section 5 : DONATIONS and Section 6 : BANK ACCOUNT INFORMATION.  The treasurer is responsible for the approval of publication material of the Group.

 

Subordinate Committee (SUBCOM) : The number of SUBCOM members is not limited but the minimum is 10.  The tentative responsibility is to assist EXCO in all management tasks.  The SUBCOM is responsible for all sorts of material publication of the Group but prior approval has to be obtained from the treasurer.  The SUBCOM will cooperate with the secretary in the reading material loan and activity loan for members.

 

Section 8 : COMPANY ADVISORS

The numbers of Group advisors are not limited.  The main tasks are to provide advice to EXCO in handling specific issues relevant to the organization based preferably on the execution of activities in parallel to the interest and welfare of the members majority of which are interested in community education.

 

Section 9 : GENERAL ELECTION AND DECISION MAKING

Two-third majority is required for making any formal decision relevant to the operation of the organization.  The term of service is minimum 1 year of which the election will be held in September each year.

 

Section 10 : CASE SELECTION IN THE OPERATION OF ROWVILLE LIBRARY CHINESE FRIENDSHIP GROUP (“THE GROUP”)

1. The Group welcomes the participation and memberships for resident of various background for comments, suggestions and contribution towards the proper organization management.

2. Proper language should always be used in the activity of the organization based on the rules and regulations of the Australian society.

3. The practises of various activities, for example, quizzes, competition, exhibition, publication, industrial visit and academic counselling are always welcome as forms of requirement for the sustenance of the organization but emphasis will be placed on the quality of the program performed and overall co-operation among the members in voluntary contribution to the education program for the community.

 

Section 11 : ESTABLISHMENT OF THE PUBLIC FUND

The establishment of the Australian Chinese Community Necessitous Circumstances Fund (“ACCNCF”) is to be maintained for the relief of persons in Australia who are in necessitous circumstances.  The Fund is established to receive all gifts of money or property for this purpose and any money received because of such gifts must be credited to its bank account.  The Fund must not receive any other money or property into its account and it must comply with the Income Tax Assessment Act 1997 (Commonwealth Australia).

 

Section 12 : INFORMING THE TAXATION OFFICE

The organization must inform the responsible taxation office for the non-profit organizations as soon as possible if :

(a)        it changes its name or the name of its public fund; or

(b)        there is any change to the membership of the management committee of the public fund; or

(c)        amongst other things there has been any material changes to the rules of the society or the Australian Chinese Community Necessitous Circumstances Fund (“ACCNCF”)

 

Section 13 : MINISTERIAL RULES

The organization will comply with any rules that the Treasurer and the Minister with responsibility for the charitable organizations may make to ensure that gifts made to the fund are only used for its principal purpose.

 

Section 14 :  NON-FOR-PROFIT ORGANIZATION

The income and property of the organization shall be used and applied solely in promotion of its objects and no portion shall be distributed, paid or transferred directly or indirectly by way of dividend, bonus or by way of profit to members, directors, or trustees of the organization.

 

Section 15 :  CONDUIT POLICY

Any allocation of funds or property to other persons or organisations will be made in accordance with the established purposes of the organization and not be influenced by the preference of the donor.

Section 16 :  PUBLIC FUND WINDING-UP

In case of the winding-up of the Fund or if the endorsement of the Fund as a deductible gift recipient is revoked, any surplus assets are to be transferred to other deductible gift recipient.

 

Section 17 :  STATISTICAL INFORMATION

Statistical information requested by the Australian Taxation Office (ATO) on donations to the Fund will be provided within four months of the end of the financial year.  An audited financial statement for the organization and its public fund will be supplied with the annual statistical return if requested.  The statement will provide information on the expenditure of public fund monies and the management of public fund assets.

 

Section 18 : OBJECTIVE OF PUBLIC FUND

The object of the Australian Chinese Community Necessitous Circumstances Fund (“ACCNCF”) is to provide relief to persons in Australia who are in necessitous circumstances.

 

Section 19 :  ACTIVELY SEEKING DONATION

Members of the public are to be invited to make gifts of money or property to the fund for the charity purposes of the organization.

 

Section 20 : PUBLIC FUND BANK ACCOUNT

A separate bank account is to be opened to deposit money donated to the fund, including interest accruing thereon, and gifts to it are to be kept separate from other funds of the organization.  Money from interest on donations, income derived from donated property, and money from the realization of such property is to be deposited into the fund.

 

Section 21 : PUBLIC FUND’S MANAGEMENT COMMITTEE

A committee of management will administer the fund.  The committee will be appointed by a general meeting of the organization and be living permanently in Australia.  A majority of the members of the committee are required to be responsible persons as defined by the Guidelines to the Gift Pack published by Australian Taxation Office (ATO).

 

Section 22 : INCOME OF PUBLIC FUND

Money from interest on donations, income derived from donated property, and money from the realisation of such property is to be deposited into the fund.  The release of monies from the public fund account and the management of, and sale of, public fund assets must be authorised by the fund’s management committee.  Members of the public fund management committee permanently located in Australia must be the only signatories to the public fund account.

 

Section 23 : NOT-FOR PROFIT OF PUBLIC FUND

It is a requirement of both the organisation and the public fund that they be operated on a not-for-profit basis.

 

Section 24 : PUBLIC FUND RECEIPTS

Receipts are to be issued in the name of the fund and proper accounting records and procedures are to be kept and used for the fund.  The fund will be operated on a not-for-profit basis.

 

Section 25 : DEFINITION

Group means “Rowville Library Chinese Friendship Group”.

Minister means “Minister of the Department of Families, Community Services and Indigenous Affairs Australia”.

Fund means Australian Chinese Community Necessitous Circumstances Fund (“ACCNCF”) in Australia.
